International law, as a legal order, is distinguished from national and internal legal systems due to the absence of a centralized enforcement mechanism. Unfortunately, this fundamental weakness is also evident in the realm of international human rights protection. A considerable gap persists between the human rights norms that are observed and those that have been accepted by the international community as binding obligations. In a world where human rights are continuously and systematically violated, addressing such violations and prosecuting perpetrators, particularly in Africa, which has witnessed numerous civil wars and widespread human rights abuses, has become a critical global concern. The right of individual petition, as a form of legal remedy, plays a significant role in the protection of fundamental human rights and serves as a guarantee for their observance at both national and international levels. This article aims to examine the procedures for filing individual complaints before the African Court on Human and Peoples’ Rights, one of the two continental human rights mechanisms in Africa, with particular focus on its statute and the procedural principles outlined in its foundational treaties.
